Sharia is the divine law in normative Islam. The brutality and extreme human rights abuses being perpetrated in Afghanistan (and in other Sharia jurisdictions) are in full accordance with Sharia, despite the routine branding of critics of Islam.
Under Sharia:
Hudud Crimes (apostasy, rebellion against the ruler, theft, armed robbery, adultery, slander, and alcohol use) carry penalties including amputation of hands and feet, flogging, and death.
Furthermore, sharia is known to abuse women. The Taliban, who are infamous for their treatment of women, are fully justified by Islamic law.
Some examples from the Qur’an:
Quran (4:34) “Men are in charge of women, because Allah has made one of them superior to the other, and because they spend from their property (for the maintenance of women). So the good women are the obedient ones, keeping secret what Allah has kept. As for those from whom you fear rebellion, admonish them and banish them to separate beds, and scourge them. So if they obey you, don’t look for a way against them.”
Quran (33:33) “And remain quietly in your homes…” The women are confined to their homes except when they have permission to go out.
(Quran 24:31) And tell the believing women to reduce their vision and take care of their private parts and not to expose their ornaments except what appears on them and to wrap themselves [a portion of] their heads on their chests, and expose their clothing only to their husbands, to their fathers, to their husbands’ fathers, to their sons, to their husbands’ sons, to their brothers, to their brothers’ sons, to their sisters’ children, their wives, what their right hands possess, or those male attendants who have no physical desire, or boys who are not yet aware of women’s private aspects. And don’t let them kick to reveal what they hide from their attire. And turn to Allah in repentance, all of you, O believers, so that you may succeed.
(Quran 33:59) O Prophet, tell your wives, your daughters and the women of the believers to cover themselves with their outer garments.
Turkish President Recep Tayyip Erdogan has also stated that “Turkey has nothing that contradicts the beliefs of the Taliban.”
“Afghan Supreme Leader Orders Full Implementation of Sharia Law”, Agence France-Presse, November 14, 2022:
Afghanistan’s supreme leader has ordered judges to fully apply aspects of Islamic law that include public executions, stoning, flogging and amputation for thieves, the Taliban’s top spokesman said.
Zabihullah Mujahid tweeted on Sunday that Haibatullah Akhundzada’s “mandatory” order came after the secret leader met with a group of judges.
Akhundzada, who has not been filmed or photographed in public since the Taliban returned to power in August last year, rules by decree from Kandahar, the movement’s birthplace and spiritual heart.
The Taliban promised a softer version of the harsh rule that characterized their first term in power, from 1996 to 2001, but have gradually clamped down on rights and freedoms.
“It carefully examines the files of thieves, kidnappers and seditious people,” Mujahid was quoted as saying by Akhundzada. Those files in which all the sharia [Islamic law] the conditions of hudud and qisas have been met, you are obliged to implement them. This is the sharia rule, and my order, which is mandatory.”
Mujahid was not available Monday to expand on his tweet.
Hudud refers to crimes for which, under Islamic law, certain types of punishment are exacted, while qisas translates to “retaliation in kind,” effectively an eye for an eye.
Hudud crimes include adultery, and falsely accusing someone of it, drinking alcohol, stealing, kidnapping and highway robbery, apostasy, and rebellion.
Qisas covers murder and deliberate injury, among other things, but also allows families of victims to accept compensation in lieu of punishment.
Islamic scholars say that crimes leading to hudud punishment require a high degree of proof, including, in the case of adultery, confession or being witnessed by four adult male Muslims.
Since last year’s seizure of power, videos and images of Taliban fighters conducting summary floggings of people accused of various crimes have appeared frequently on social media.
On several occasions, the Taliban have also displayed in public the bodies of the hijackers who they said were killed in gun battles.
There have also been reports of adulterers being flogged in rural areas after Friday prayers, but independent verification has been hard to come by….
